  • A new article by TLA partner Maria Suchkova discussing the ECtHR Grand Chamber judgment in Delfi AS v. Estonia
    23.10.2015

A new article by TLA partner Maria Suchkova analysing the ECtHR Grand Chamber judgment in Delfi AS v. Estonia dated 16 June 2015 published in the International Justice Journal. The case concerns an Internet news portal liability for user-generated content with ECtHR stating that holding the portal responsible for moral damage done to third parties as a result of the publication of offensive comments by users in its comment environment may not entail a violation of Article 10 of the Convention.

Importance of this decision for the development of the ECtHR case-law is due to the fact that for the first time in its practice the Court ruled on the issue of an online portal liability for the user-generated content and outlined the path for defining the scope of the portal's  obligation to protect rights and reputation of third parties when allowing the visitors to post the comments.

  • Maria Issaeva will participate in the International Conference on Development of Russian Law in Helsinki
    23.10.2015

and Market Economy in Russia, which will take place in Helsinki on October 23-24, 2015. TLA managing partner Maria Issaeva will present there her paper on effectiveness of the ECtHR vis-à-vis Russia.

This conference continues the series of workshops, seminars, and conferences in Russian law, organized by the Faculty of Law since 2008. This annual event is devoted to discussions of the new and important topics within the field of Russian law and legal studies. This year’s focus is on legal policy and economic crisis in the context of the rule-of-law state and market economy in Russia.

Alongside Maria Issaeva section Russia and the European Court of Human Rights: Assessing Recent Developments will also have speakers from the Moscow State University, Uppsala University, ECtHR, and Moscow Institute for Law and Public Policy discussing Russia’s judicial system in its cooperation with the ECtHR. Maria will present her paper Is the European Court of Human Rights effective vis-à-vis Russia: looking through the prism of the Ukrainian crisis. In her work she poses a question whether ECtHR mechanisms are less effective when dealing with some countries, and, if so, why? She argues that it is so, indeed, and in Russia it is due to the particular understanding of the notion of human rights. Maria uses the Ukrainian crisis as an illustration of certain negative developments in the area. However, the crisis only triggered what was already there. Therefore, in order for the human rights to make their way to Russia, the problem should be addressed taking into account Russia's specific Soviet heritage.
